Section 5(3) of the DPDP Act 2023 gives every Data Principal the option to access your privacy notice in English or any of the 22 languages in the Eighth Schedule to the Constitution. Most compliance tools treat that as a footnote. EasyDP treats it as the product: notices and consent flows in the Indian languages your customers actually speak, delivered wherever your customer is.
DPDP Act 2023, Section 5(3) · Eighth Schedule, Constitution of India · Updated July 2026
| No. | Obligation | What the Act says | Citation |
|---|---|---|---|
| 01 | The language option is the customer’s, not yours | The Act gives the Data Principal the option to access the notice in English or any Eighth-Schedule language — the business must be able to serve it. | Act · S.5(3) |
| 02 | "Informed" consent implies comprehension | Consent must be informed and unambiguous (Section 6). A Hindi-speaking customer tapping through an English-only legal notice is a weak foundation for either. | Act · S.6(1) |
| 03 | Plain language is mandatory | The notice must present its account of the data and purposes in clear and plain language, understandable on its own — in whichever language it is served. | Rules · R.3 |
English, Hindi, Tamil, Telugu, Kannada and Malayalam — professionally maintained translations of your notice and consent flow, not machine output pasted into a template.
Update your notice once; every language version updates together and is archived together, so the record shows exactly what each customer saw, in which language.
The same multilingual flow runs on your website, in WhatsApp journeys, and on QR codes for offline collection — the channels where Indian customers actually are.
Every consent record stores the language it was given in — evidence that the notice was genuinely accessible to that customer.
The notice that accompanies a consent request must be available, at the customer’s option, in English or any of the 22 languages of the Eighth Schedule (Section 5(3)). In practice: detect or ask for the customer’s language, serve the notice and consent action in it, and record which language version was shown. EasyDP does all three automatically, in your customer's own language.
